What Supreme Court said on modifying its order regarding marking appearance of lawyers

The Supreme Court on Wednesday said it will pass an order next week on Supreme Court Bar Association (SCBA)'s plea seeking modification to an earlier order which mandated that only those lawyers who are authorised to argue a case can mark their appearance in a particular case and not lawyers who simply assist the arguing counsel. .A Bench of Justices Bela M Trivedi and Satish Chandra Sharma heard SCBA President Kapil Sibal who urged the Court to allow advocates-on-record (AoRs) to mark appearance of all lawyers appearing in the court in a case even though they might not be arguing the matter."But how can we allow appearance of lawyers coming with other lawyers ? No, no modification," the Court remarked initially.Justice Trivedi added that sometimes names of lawyers run into 10 pages but order is of two line. "When AoR signs vakalatnama, he must state that the person authorising him is present," the judge said..Sibal agreed and said that the Bar is also identifying the issues on their end. Nevertheless, he urged the Court to pass an order.He also pointed out that many a time, there are lawyers who work behind the scene (preparing petitions and written submissions) though they don't end up arguing the matter."The problem is who are present in court along with lawyer. How to identify them. But the concern is lawyers who come to assist in important cases.. like in Bombay case the names of juniors were added," he added.At this, the Court said,"Yes, we must see them".The Court then said it will pass orders next week..The Court in September 2020 had ordered the CBI to carry out an inquiry into a case where a litigant had denied filing a special leave petition (SLP) before the top court and had claimed that he never hired any of the lawyers to represent him.
