The Calcutta High Court on Monday asked the Central Bureau of Investigation (CBI) to clarify key aspects of its probe into the rape and murder of a resident doctor at Kolkata's RG Kar Medical College & Hospital in August last year..The Court was hearing a plea filed by the parents of the deceased doctor, seeking a fresh investigation into the incident. Justice Tirthanker Ghosh asked the CBI to answer to a few questions on next date of hearing:- Whether the language of the charge indicated a case of a single accused or gang rape.- Whether CBI ever considered invoking Section 70 of the Bharatiya Nyaya Sanhita (BNS), particularly if multiple suspects were involved. With the first chargesheet already having been filed, the Court pressed the CBI on the status of further investigation and the second chargesheet. However, it made it clear that it would only entertain case diaries, not a formal report..The Calcutta High Court had in August last year directed CBI to investigate the case on a priority basis. The 31-year-old junior doctor was found dead at the RG Kar Medical College and Hospital, sparking nationwide outrage and eventually leading to the resignation of the college principal, Dr Sandip Ghosh. On August 13, 2024, the Court transferred the probe in the matter to the CBI..Ghosh was arrested by the CBI on September 2 after the Calcutta High Court had on August 23 ordered the agency to investigate the alleged financial irregularities and mishandling of key evidence in the rape case at RG Kar Medical College and Hospital.A Kolkata court granted him bail on December 13, 2024 since the CBI couldn't file the chargesheet within the stipulated 90-day period. In January this year, the trial court convicted and sentenced the prime accused, Sanjay Roy on charges of rape and murder after an in-camera trial that lasted 57 days.Roy, civic volunteer with the city police, was arrested by the Kolkata Police on August 10, 2024 a day after the incident. He was sentenced to life imprisonment. In February this year, the High Court dismissed the appeal filed by the State government seeking the death penalty for Roy. A bench of Justices Debangsu Basak and Md Shabbar Rashid refused to grant permission to the State to file such an appeal since it was the CBI which had probed the matter and conducted the prosecution. It thus allowed the CBI to file an appeal for the same punishment..Calcutta High Court rejects State's appeal for death to RG Kar convict, allows CBI to appeal
