The Uttarakhand High Court on Friday vacated the stay on the conduct of panchayat elections in the State [Ganesh Datt Kandpal v State of Uttarakhand and Ors]. .A Division Bench of Chief Justice G Narender and Justice Alok Mehra passed the order after the State government furnished documents regarding the rotation-based reservation rules.A detailed order is awaited. .The panchayat elections are scheduled to be held next month but the High Court had stayed the same on June 23 after a plea was filed alleging that the government’s reservation policy violates Section 126 of the Uttarakhand Panchayati Raj Act, 2016 and Article 243T of the Constitution. Petitioner Ganesh Datt Kandpal argued that the government has reset the reservation of seats. It was argued that under the current policy, a seat is reserved for a particular category for three years. However, the government is bringing in a new policy which means that some of the seats which were reserved for the last three years may be reserved for more time. .Advocate Shobit Saharia appeared for petitioner Ganesh Kandpal.
