You have guts to file this? Supreme Court pulls up murder convict for second plea seeking time to surrender

The Supreme Court on Wednesday censured a murder convict for again moving the top court for an extension of three weeks to surrender before the jail authorities [VINOD @ GANJA Versus STATE (GOVT OF NCT OF DELHI)]..The Bench of Justice Ahsanuddin Amanullah and Justice SVN Bhatti noted that the convict Vinod @ Ganja's petition seeking extension of furlough had already been turned down on May 14 by a Bench headed by Justice AS Oka."How dare you file this...coordinate bench headed by Justice [Abhay] Oka (rejected it) and you have guts to file it during vacation," the Court remarked..Senior Advocate Rishi Malhotra, representing the petitioner, submitted that he was seeking three more weeks to surrender, till the Delhi High Court decides his plea for premature release on July 10. However, the Court said he had already moved the top court earlier and his request was denied. However, Malhotra said Justice Oka-led bench had granted him three weeks to surrender. Since Court was unconvinced with Malhotra's argument, he said the convict will surrender today itself. However, the Court said it was taking serious note of the issue of him again seeking extension of time to surrender and would pass an order on Thursday..Meanwhile, it directed the convict to surrender before the jail authorities."Filing of present case is absolutely uncalled for unwarranted and needs to be dealt with strictly. Accordingly, it is directed petitioner should surrender today itself and the Court will consider what other order needs to be passed in facts and circumstances of the case," it said..Advocate-on-Record (AOR) Sweta Rani then sought permission to withdraw the plea."Lordship, I am AOR in the matter, I am extremely sorry. I may be allowed to withdraw this petition. My humble request." However, the Court turned down the request."Not permitted. Rejected.".The petitioner had approached the Delhi High Court earlier seeking his premature release as per the State policy. He has undergone more than 14 years of actual sentence and 16 years with remission, as per the plea.The High Court had on May 5 issued notice on the plea but turned down his application for stay on surrendering on May 20. He had been granted furlough by the jail authorities on April 28. "Since the main petition is coming up for hearing on 10.07.2025, this Court, at this stage, does not find it appropriate to pass any order or to direct the petitioner to not surrender on 20.05.2025 in FIR bearing No. 40/1992, registered at Police Station Mukherjee Nagar, Delhi for the offences punishable under Sections 302/307/34 of IPC and Section 27/30/54 of the Arms Act," the High Court had said.The petitioner had then moved the top court which agreed with the High Court decision but granted him three weeks to surrender. On May 27, he moved an application seeking extension of time to surrender. The same was heard today and effectively turned down.
