Sunjay Kapur estate dispute: Delhi High Court deletes appearance of Kapur's sister in Karisma Kapoor children's suit

The Delhi High Court on Friday said that its order in the Sunjay Kapur estate dispute matter will be rectified to the extent that it recorded the presence of lawyers appearing for his sister, Mandhira Kapur. .Justice Jyoti Singh passed the order. .The High Court had recorded the presence of Senior Advocate Geeta Luthra and other lawyers for Mandhira Kapur on September 10 while hearing a plea filed by Karisma Kapoor's two children seeking a share in their father Sunjay Kapur's estate. The next day, on September 11, Luthra mentioned the matter before the Court, pointing out that the appearance of Mandhira Kapur and her alleged counsel had been incorrectly recorded and requested that the record be corrected. She pointed out that Mandhira Kapur was not a party to the proceedings and had not filed any impleadment and that no one had appeared on her behalf. Justice Singh then said that an application may be filed to this effect. .Meanwhile, Priya Kapur and her minor son (the main defendants in the suit) filed a rectification application before the Court, which was heard today. In the application, Priya Kapur argued that the lead counsel stated to have appeared for Mandhira Kapur, was not present in the court and did not advance any submissions even though the Bench called upon each counsel present in court. “That upon the careful perusal of the Case History of the captioned suit from the website of the Hon’ble High Court of Delhi it is apparent and clear that Ms. Mandhira Kapur has not filed any application to be impleaded as a party to the captioned suit, and therefore the said deliberate and mischievous attempt is to gain a back door entry into the proceedings before this Hon’ble Court and take a benefit out of the present lis” the plea read. It added that Mandhira Kapur has made a “mischievous attempt to mislead” the court and this is neither permissible nor legally valid. “It is pertinent to note that the manner in which Ms. Mandhira Kapur has attempted to join the proceedings is unknown to the law, and is an abuse of process of law in an attempt to create an incorrect record on the record of this Hon’ble Court,” the application alleged. .Priya Kapur was represented by Senior Advocates Rajiv Nayar and Shyel Trehan briefed by Bahuguna Law Associates through Meghna Mishra, (Senior Partner), Ankit Rajgarhia (Partner Designate), Tarun Sharma (Principal Associate) and Rohit Kumar (Associate). Advocates Saurav Agarwal, Ravi Sharma, Shantanu Agarwal and Madhulika Rai Sharma appeared for Karisma Kapoor's children.
