PMLA accused entitled to copies of material not relied on by ED: Supreme Court

The Court held that accused can also apply to recall prosecution witnesses and cross-examine them based on such documents.

In a significant ruling, the Supreme Court on Wednesday ruled that those accused of offences under the Prevention of Money Laundering Act, 2002 (PMLA) are also entitled to copies of documents that the Enforcement Directorate (ED) does not rely on for investigation or prosecution [Sarla Gupta and anr v. Directorate of Enforcement].
