P&H High Court calls for list of NDPS accused in Haryana who haven't been arrested for over 6 months

The Punjab and Haryana High Court has directed the Director General of Police (DGP) of Haryana to file a list of all drugs cases in which the accused have not been arrested for over six months [Pargat Singh alias Kaka Son of Raj Singh vs State of Haryana and Others]..Justice NS Shekhawat said that in various cases, there was no supervision of investigation in the cases registered under Narcotic Drugs and Psychotropic Substances Act (NDPS Act) in different districts of Haryana.“Consequently, the DGP, Haryana is directed to file a list of all the cases registered against the accused under the provisions of NDPS Act in all the police stations in the State of Haryana, where the accused have not been arrested for the last more than six months,” the Court ordered on August 18..It also sought the following information:(i) number and other details of FIRs registered under the provisions of NDPS Act; (ii) names of the accused, who have not been arrested for the last more than six months; (iii) steps taken by the police to arrest such accused;(iv) whether any action has been taken against the IO in such cases if some negligence is found on the part of the IO;(v) whether any steps have been taken by the police to declare such accused as proclaimed offenders/proclaimed persons under the provisions of Section 84 of BNSS;(vi) whether any application has been moved before courts for attachment of the moveable and immovable properties of such absconders;.The High Court was hearing a petition moved by an accused for a fair and impartial probe into a drugs case registered in February this year. The bench noted that the petitioner was involved in 12 criminal cases.It expressed surprise that the accused was yet to be arrested even after six months since the NDPS Act case was registered.“From the above referred list of cases, it is apparent that the present petitioner is a habitual offender and is a notorious drugs smuggler. Even, the FIR was registered on 06.02.2025 and even after a period of six months, the police has failed to take action against such a drugs smuggler, which clearly proves that the officials of local police are hand in glove with the accused in the present case,” the Court observed.Therefore, it sought an affidavit about similar cases from the DGP and listed the matter for further hearing on September 16..Advocates Aditya Sanghi and Kartik Mittal appeared for the petitioner.[Read Order]
