MP Amritpal Singh granted leave: Lok Sabha to Punjab & Haryana High Court

The Punjab and Haryana High Court was on Wednesday informed that the Lok Sabha has granted 54 days of leave of absence to Member of Parliament (MP) Amritpal Singh who is detained in jail under the National Security Act (NSA) in Assam [Amritpal Singh v. Union of India and Others]..The submission was made during the hearing of Singh's plea seeking directions to permit him to attend Lok Sabha proceedings. It was his apprehension that his parliamentary constituency would be declared vacant after continuous absence of 60 days.Considering the grant of leave, the Division Bench of Chief Justice Sheel Nagu and Justice Sumeet Goel said,"This petition had been filed by the petitioner, who is an inmate at Central Jail, Dibrugarh in Assam seeking the following reliefs ... so far the apprehension of the petitioner of being dismembered from the Parliament due to his absence is concerned, the same stands assuaged by the letter dated 11.03.2025 issued from the Lok Sabha Secretariat granting leave of absence of 54 days ... thus the relief sought stands satisfied.".Pertinently, the leaves have been granted for the parliament sittings held last year. The letter of Lok Sabha Secretariat was produced by Additional Solicitor General Satya Pal Jain, who was representing the Secretary General of the Lok Sabha and the Union of India..Senior Advocate Anupam Gupta represented the State of Punjab..Following his alleged attempts to revive the Khalistan movement in Punjab, Singh is currently under detention in Assam under the National Security Act since 2023. He was elected to the Lok Sabha from the Khadoor Sahib constituency a year later.He had moved the Court after he failed to receive any response from the District Magistrate at Amritsar to his request to attend Parliament.“An MP under preventive detention has the right to attend Parliament sessions. This is because parliamentary privileges and duties take precedence over detention in non-criminal (preventive) cases,” he argued.His petition against his detention under the NSA is pending before the High Court.
