The Supreme Court on Monday granted anticipatory bail to Tamil Nadu Member of the Legislative Assembly (MLA) 'Poovai' M Jagan Moorthy in a case concerning the abduction of a minor boy [M Jegan Moorthy Vs The Inspector Police]..A Bench of Justice Manoj Mishra and Justice NK Singh passed the order on an appeal filed by the MLA after the Madras High Court rejected his anticipatory bail plea. "The matter requires consideration. Issue notice. In the meantime, if the petitioner is arrested in connection with FIR No.101/2025 registered at PS – Thiruvalangadu (renumbered as C.R. No.1/2025), he shall be released on personal bond of Rs.25,000/-, subject to the undertaking that he shall cooperate in the investigation and will not threaten the witnesses or tamper the evidence," the Supreme Court ordered. .The case stems from the alleged abduction of a teenager, after his elder brother, aged 23, married a 21-year-old woman from Theni against her family's wishes. The couple went into hiding after they eloped. According to the complainant (the boy’s mother), members of the girl’s family, along with a group of miscreants, forcibly entered their home searching for her elder son. When they were unable to find him, they allegedly abducted the complainant's younger son, who was later found injured and abandoned near a hotel.Following a police complaint, several individuals were arrested, some of whom reportedly named MLA Jagan Moorthy as being involved in the matter. Tamil Nadu Additional Director General of Police (ADGP) HM Jayaram was also suspected of being involved in the case, over which he was suspended from service. Jagan Moorthy's plea for anticipatory bail was rejected by the Madras High Court on June 27, citing prima facie material indicating his involvement.Aggrieved by the order, he moved the Supreme Court, contending that he was being falsely implicated based solely on the confession of a co-accused, without any direct or corroborative evidence linking him to the alleged offence..Senior Advocate Siddharth Luthra represented Moorthy before the top court. He maintained that Moorthy had been falsely implicated with mala fide intent. He argued that, given the facts and circumstances of the case, custodial interrogation was not justified. After hearing preliminary submissions, the top court gave the MLA protection from arrest by ordering that he be released on furnishing a ₹25,000 personal bail bond in case he is arrested before the matter is heard next. .Senior Advocate Sidharth Luthra, along with Senior Advocates S Prabakaran, Apurba Kumar Sharma, and PS Amalraj, and Advocates Muthuchharan Sundresh, Ma Gouthaman, Velmurugan, Usha Prabakaran, Maheswaran Prabakaran, Anuradha Arputham, M Naveen, R Senthil Kumar, G Jai Singh, Dr Ram Sankar, Harini Ramsankar, and Ram Sankar, appeared for Moorthy. .[Read Order]
