Delhi High Court sends ‘Bhoot Chips’ dispute between Too Yumm and Haldirams to mediation

The Delhi High Court on Tuesday referred to mediation a suit filed by the manufacturers of Too Yumm against Haldirams alleging that the latter copied the distinctive packaging of its popular "Bhoot Chips" product. [Guiltfree Industries v. Anantjeet Industries LLP].On February 4, Justice Mini Pushkarna had ordered Haldirams to cease manufacturing and distributing products with the packaging. The order, however, said that “the products already packed in the aforesaid packaging and released in the market, shall be allowed to be exhausted.”The Court also said that Haldirams was free to use its own trademarks and other branding elements, provided the packaging design is sufficiently different from Too Yumm's..Too Yumm alleged that Haldirams had copied the unique and distinctive packaging of its Bhoot Chips product in the packaging of the latter's ‘Takatak Bhoot Chilli’. It further claimed that Haldirams' packaging was a “slavish imitation” of its artistic trade dress, which it conceived and created. According to the company, it discovered the alleged infringement in January 2025 and promptly filed the suit to protect its intellectual property rights.Too Yumm argued that it had created and adopted distinctive artistic works and packaging for Bhoot Chips, which have become synonymous with its brand. It further contended that the defendant had only recently adopted the similar packaging, raising concerns about potential market flooding with imitative products..In today’s hearing, Advocate Neeraj Grover argued that Too Yumm had not made Haldirams the first defendant deliberately, so that it would not appear in court based on the cause list. Alleging malafide, he urged the court to vacate the order. The Court, however, referred the dispute to mediation. It clarified that the cut-off date by which Haldirams has to cease manufacturing of the product was February 4.
