The Delhi High Court on Monday refused to grant an interim injunction restraining Mahindra Last Mile Mobility Limited from selling its recently announced Electric Vehicle (EV) 'eZEO' [Gensol EV Vs Mahindra Last Mile Mobility Limited]..Gensol Electric Vehicles has filed a suit contending that it owns the trademark 'eZio' and that Mahindra's usage of 'eZEO' could confuse the public.Justice Amit Bansal today dismissed Gensol's application for interim relief in the matter."The applicant (Gensol) has failed to make a case for interim injunction. The application is dismissed," the Court held. .Gensol had filed its suit against Mahindra in September 2024 over the latter launching an EV called 'eZEO.' Gensol contended that it owns the mark 'eZio' and informed that it plans to launch a vehicle bearing this name in 2025. .In October 2024, Gensol pressed for an immediate court order to prevent Mahindra from launching commercial electric vehicles using the trademark "eZEO." Mahindra countered that the launch date was publicly announced earlier and that they had already sold vehicles using this trademark, suggesting that Gensol's request was untimely.After considering these arguments, the Court has now declined to grant any immediate interim relief or Gensol. The Court also instructed Mahindra to submit a written response to Gensol's claims within ten days. "In these circumstances, I am of the view that the defendant (Mahindra) has to be given an opportunity to file a reply before considering the grant of any interim injunction. Hence, I am not inclined to grant an ad interim injunction order at this stage," the Court said. .In 2023, Gensol had obtained a trademark registration for the mark 'eZio' under class 12. Class 12 covers vehicles and parts, including engines, motors, couplings, wheels, bumpers, windscreens, steering, and fittings for land, air, and water transport; electric, hydrogen, and diesel-powered vehicles, remote-controlled vehicles and locomotives..Mahindra sought registration of the mark 'eZeo' in the same class in September 2024. However, the same is pending consideration before the Registrar of Trademarks. .Mahindra eZEO is a small commercial electric vehicle (SCV) launched by Mahindra & Mahindra. It is designed for last-mile delivery and urban transportation. The eZEO features high-voltage architecture, offering a longer range and faster charging times. It also incorporates advanced driver-assistance systems (ADAS) for enhanced safety.Gensol Electric Vehicles is set to launch its first compact electric vehicle, the 'Ezio', at the Bharat Mobility Global Expo 2025, scheduled from January 17 to January 22, 2025, at the Bharat Mandapam in New Delhi.
