"No police station by that name exists:" Allahabad High Court seeks explanation from Police SI for furnishing name of non-existent police station

The Allahabad High Court has issued show-cause notice to a Police Officer seeking explanation for misleading the Court by giving details of a non-existent police station (Manavvar v. State of UP)..Single-judge Justice JJ Munir, came down heavily on the police authorities and issued notice to Amit Kumar, Sub-Inspector of Police, District Bijnor, Uttar Pradesh for telling the Court that there was a case registered against an accused person at Police Station, Akbarabad, District Amroha when in fact, no such police station exists. "There is no police station by that name in existence" the court observed. .The Court was hearing a bail application moved by the applicant-accused who was arrested in relation to a crime. When the application came up for hearing on June 25, 2021, the Additional Government Advocate (AGA) made a statement on the basis of instructions received that there is a case against the applicant under the UP Gangsters Act at Police Station Akbarabad.When the matter was heard on July 2, the counsel for the applicant/ accused submitted that applicant was the victim of an overenthusiastic action by a rather "mysterious group of policemen" constituted into Special Operation Groups. It was submitted that the accused was arrested from his home and falsely foisted with recovery of some cars along with motorbikes. Further, it was also stated that in fact "there is no Police Station going by the name of Police Station Akbarabad in the district of Amroha.".The Court then asked the AGA about the same who did not dispute the applicant lawyer's claim about the police station. Upon an inquiry being made from the AGA about the identity of the author of the instructions on the basis of which statement was made on June 25, it transpired that relevant instructions were given by Amit Kumar. .Accordingly, the show-cause notice was issued to Kumar. "Issue notice to Amit Kumar, Sub-Inspector of Police, Police Station Kotwali, District Bijnor to show cause why appropriate action may not be initiated against him for misleading the Court by supplying false and incorrect instructions to the learned Government Advocate in that, that there is no case crime under Section 3(1) of the UP Gangsters Act, Police Station Akbarabad, District Amroha against the applicant, so much so, that there is no police station by that name in existence in District Amroha," the Court ordered..The case will be heard again on July 8. .[Read order]
