Multinational eyewear company Lenskart informed the Delhi High Court recently that its use of the Titan and Fastrack trademarks and metatags was an inadvertent mistake [Titan Company Limited vs Lenskart Solutions Private Limited & Anr]. .Advocate Nishchal Anand, appearing for Lenskart, made the statement before Justice Amit Bansal. Anand said that Lenskart had no intention of infringing the trademarks and the company has taken remedial steps to remove all references to Titan from its website. .Titan had moved the Court alleging that Lenskart was using its registered marks such as ‘’Titan’, ‘TitanEye+’ and ‘Fastrack’ on its website and also as metatags to the source code of the website.It sought a permanent injunction to restrain infringement of its trademarks and passing off against Lenskart..After taking Lenskart's statement on record, Justice Amit Bansal disposed of the suit by passing a consent decree.The Court bound Lenskart to their statement.“In view of the aforesaid statement, the defendants do not wish to contest the present suit.
