The Delhi High Court on Thursday asked Delhi Police to keeps its arguments short while opposing the bail pleas of accused in the Delhi riots conspiracy case..The Division Bench of Justice Navin Chawla and Justice Shalinder Kaur said it was not conducting a trial of the case, while interjecting Special Public Prosecutor Amit Prasad."How much are you going to take? This way it will not even register much with us. Give a chart. We are losing you here in between here. We just wanted to have birds-eye of the evidence you have, not that you be commenting on each and everything like this," the Court said.It further said a brief chart on the evidence be prepared, keeping in consideration the distinction between a bail application and a final trial."Give us what you have against them... (If) we have to deal with each and everything, we will be running into 1000s of pages in bail application," Justice Chawla said.Justice Kaur elaborated on the same stating, "What is the conspiracy according to you and how the conspirators acted, that is all.".When Court interjected SPP Prasad, Senior Advocate Rebecca John, representing an accused, said the interconnectivity of evidence in the case was so tenuous that it is difficult to even answer anything."We got lost in between," Justice Chawla remarked."The conspiracy is big, it will take time," Prasad said in response.John said the accused are in custody for about five years "on something we still are not able to put together in a concise fashion".The Court then adjourned the matter to January 21. It asked the SPP to prepare a short note on his arguments..SPP Prasad earlier read the statements of witnesses and referred to the speeches of the accused to show their role in the alleged conspiracy.He said speeches given by accused including Umar Khalid, Sharjeel Imam and others were aimed at creating "fear of sense in people listening", in relation to the NRC-CAA, triple talaq, Babri Masjid and Kashmir.He also said that the accused particularly Khalid had purposefully shown themselves as being outside Delhi at the relevant time in order to project their non-involvement. "So there is concerted plan which is there to remain outside time so that I don't get trapped," Prasad added..The Court was hearing the bail petitions moved by the accused including Umar Khalid, Sharjeel Imam, Gulfisha Fatima, Khalid Saifi and others who have been in the prison for many years. Since the trial court is yet to frame the charges against them, the accused have sought bail mainly on the ground of delay in trial..During the previous hearing, the Court had asked the Delhi Police whether setting up protest sites against the Citizenship (Amendment) Act (CAA) was sufficient for the Delhi Police to invoke Unlawful Activities (Prevention) Act (UAPA) against accused in the Delhi riots conspiracy case."Is it your case that only setting up of a protest site is good enough for UAPA or is it your case that protest site which resulted in a violence is good enough for a case under UAPA. But most importantly, for us, it is the intent, under UAPA, which has to be established," it had said.
