The Supreme Court on Thursday pulled up the Central government for filing frivolous appeals against armed forces' personnel in disability pension cases..The Bench of Justice Abhay S Oka and Justice Ujjal Bhuyan impressed upon the government to evolve a policy to curb such frivolous appeals."We are of the view that the Government of India must evolve a policy. There has to be some scrutiny before a decision is taken to drag members of the armed forces to the Supreme Court," the Court said..The Court remarked that every member of the armed forces who gets relief in form of the grant of disability pension from the Armed Forces Tribunal need not be dragged to the court."Several cases we have come across are absolutely frivolous appeals. Why are they being filed? Absolutely frivolous!," it said..The Court was hearing an appeal moved by the Central government against a retired Army man. The matter was adjourned today with the Court asking the government to first inform it about any policy decision with regard to the disability pension cases. "As we have given a longer date, we call upon the first appellant to disclose whether it is willing to take such a policy decision before the next date," it said
