Sportswear company Campus Activewear has sued fashion brand Campus Sutra for alleged infringement of its trademarks - Campus/ Campus Sutra [Campus Activewear Ltd v Campus Sutra Retail P Ltd]..It has sought a permanent injunction to restrain Campus Sutra from infringing its trademark, copyrights and passing off. .Justice Amit Bansal heard the matter on July 15 when Campus Sutra’s lawyers told the Court that only three of a total of 11,000 of its designs inadvertently bore the mark Campus and got listed on online platforms. We have written to various platforms to remove the listing of these products, the Court was told. Justice Bansal also recorded the submission that the defendant (Campus Sutra) will not use the mark Campus on a standalone basis till the next date of hearing. “Mr Amit Sibal also submits that the defendant has been using the mark ‘CAMPUS SUTRA’ for its apparel since 2012. However, the defendant has never used the ‘CAMPUS’ mark for footwear. Without prejudice to the rights and contentions of the defendant, Mr. Sibal submits that till the next date of hearing, the defendant shall not use the mark ‘CAMPUS’ on a stand-alone basis, in respect of any of its products,” the Court noted. .The Court has issued notice to Campus Sutra and said that it will consider Campus Activewear’s plea for interim relief on November 10. .Campus Activewear was represented by Senior Advocate Sandeep Sethi.
