Concurrent or exclusive? The need to settle the RERA-arbitration debate

The Bombay High Court recently held in Rashmi Realty Builders Private Limited v. Rahul Rajendrakumar Pagariya that disputes between flat allottees and promoters governed where remedies exist under the Real Estate (Regulation and Development) Act, 2016 (RERA), particularly Section 18 of RERA, are not arbitrable.
